The publisher of the website www.carpol.pl (the “Website”) is “CARPOL” SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (the “Company”), with its registered office in WARSAW (02-495), ORLĄT LWOWSKICH 48/2. All rights to the Website, including its text and graphic elements, the layout of the Website pages, and other elements, are reserved, unless expressly stated otherwise. Use of the content posted on the Website does not imply the acquisition by users of any intangible property rights to the works or databases contained therein. The User may use these works or databases only within the scope of permitted use, specified in the Act of 4 February 1994 on Copyright and Related Rights (Journal of Laws No. 24, item 83, as amended), the Act of 27 July 2001 on Database Protection (Journal of Laws No. 128, item 1402), and the Act of 16 April 1993 on Combating Unfair Competition (Journal of Laws 93, 47, item 211, as amended). In particular, except as specified in these provisions, copying, modifying or transmitting electronically or otherwise any part of the Website, in whole or in part, for commercial purposes is prohibited without the prior written consent of the Company.
Personal Data Protection
The controller of personal data provided by the User is “CARPOL” SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in WARSAW (02-495), ul. ORLĄT LWOWSKICH 48/2. Personal data are processed in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter: GDPR) and other applicable regulations.
The Company processes personal data provided by the User in the contact form in order to identify the sender and process their inquiry sent via the provided form pursuant to Article 6 paragraph 1 letter b of the GDPR, and in the scope of data provided optionally, based on the User’s consent (Article 6 paragraph 1 letter a of the GDPR).
Using the Company’s forms requires the User to provide personal data necessary to contact them and respond to their inquiry. The User may also provide other data to facilitate contact or process their inquiry. Providing data marked as mandatory is required to accept and process the inquiry, while failure to provide this data will result in the inability to process the inquiry. Providing the remaining data is voluntary.
If you send the Company correspondence unrelated to the services provided to you or any other agreement concluded with you, the personal data contained in such correspondence is processed solely for the purpose of communicating with you and resolving the matter to which the correspondence relates. The legal basis for processing is the Company’s legitimate interest (Article 6, Section 1, Letter f of the GDPR) in conducting correspondence addressed to it in connection with its business activities.
When contacting the Company by telephone regarding matters unrelated to the concluded contract or services provided, the Company may request personal data only if it is necessary to process the matter to which the contact relates. The legal basis in such a case is the legitimate interest of the controller (Article 6, paragraph 1, letter f of the GDPR) consisting in the need to resolve the reported matter related to its business activities.
If the User grants consent to direct marketing via the form available on the website, personal data are processed on the basis of the legitimate interest of the controller (Article 6, paragraph 1, letter f of the GDPR), in order to conduct marketing activities consisting in the transmission of ordered commercial information regarding the company “CARPOL” SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ. The Controller also processes the personal data provided by the interested party, indicated in the form as optional, on the same basis, for analytical purposes and for building cooperation with interested parties, as well as for the optimal tailoring of marketing content addressed to interested parties.
The User may at any time opt out of receiving commercial information by using the form available at https://carpol.pl/zgody-polityka-prywatnosci or by sending a request to rodo@carpol.pl. Opting out of receiving marketing information does not affect the lawfulness of any actions taken prior to such opt-out. Without providing the required personal data, the User will not be able to subscribe.
Data may also be processed for the purpose of fulfilling the Company’s obligations under the law (Article 6, paragraph 1, letter c of the GDPR) and for the purpose of protecting the Company’s rights, including in particular the pursuit of claims (legitimate interest of the controller – Article 6, paragraph 1, letter f of the GDPR).
The Company processes the User’s personal data only for the time necessary to achieve the purposes of their processing indicated in the Policy or to fulfill the Company’s obligations imposed by law, and if the limitation period for claims arising from these purposes is longer – at the latest until the expiry of the limitation period.
Recipients of personal data may include entities cooperating with the Controller for the data processing purposes indicated above, IT service providers, as well as entities providing accounting, consulting, and marketing services to the Controller. Personal data may be transferred by the Controller outside the EEA. Transfers may only occur to a country covered by the European Commission’s decision on adequate personal data protection, and in other countries, only to an entity that ensures appropriate safeguards for such data, in particular in the form of standard contractual clauses. Under the terms of personal data protection regulations, the User has the right to request access to the provided data, rectification, restriction of processing, deletion, the right to data portability, and the right to lodge a complaint with the President of the Personal Data Protection Office.
In cases where processing is based on the legitimate interest of the controller (Article 6 paragraph 1 letter f of the GDPR), the User has the right to object to the processing of personal data if this is justified by the specific situation of the Customer or if personal data are processed for direct marketing purposes.
